Investigation of Third Party's Trademark Fair Use Doctrine on the Introduction of Goods and Services
The legal system over trademarks has continually been trying to prevent any breach of trade marks by providing preparatory measures. The fair use doctrine on the introduction of following goods and service is of the exceptions related to use of trademark. Based on this doctrine, the trademark of third party is used to introduce its following goods and service or to comment, criticize or praise the owner of that trademark. Such a use necessitates compliance with some conditions in which non-compliance causes the trademark to be breached. This article shall analyze the doctrine of fair use for the introduction of goods and service and present the criteria of identification of this doctrine from comparative perspective.
